1. About these terms
These terms govern your use of landie.com.au (the "website"), your pre-order, and the Landie phone service, all provided by Landie Communications Pty Ltd (ABN 71 691 334 291) ("Landie", "we", "us"). By using our website or placing an order, you agree to these terms.
2. Who can order
You must be at least 18 and ordering as a parent or guardian. The person who orders is the "account holder" and is responsible for setting up the Landie and supervising how their child uses it. Landie is currently sold for personal and household use in Australia only.
3. Pre-orders
We're currently taking refundable pre-orders. A few things to know:
- When you pre-order, we charge you for the device only. Your subscription plan is not charged until your phone is activated.
- Landies are not yet shipping. We're aiming to ship from July, though some orders may ship earlier. We'll keep you updated, and we may adjust specifications, pricing, or timing before your order ships.
- Your pre-order is fully refundable at any time before your phone ships — just contact us at hello@landie.com.au.
4. Your plan
Every Landie comes with a free plan at no monthly cost. The free plan lets you make free Landie-to-Landie calls (calls between Landie phones) and call 000 (while your home internet is live). If you'd like to call any phone number, you can choose our paid plan: your first month is free, then it's $19.99 per month. You're never required to take the paid plan. The paid plan is billed from the time you activate it. You can cancel any time, with no lock-in and no exit fee. If you cancel during your free first month, you simply revert to the free plan before any charge. If you cancel later, your paid plan runs until the end of the month you've paid for, then your Landie reverts to the free plan. If we ever change the price, we'll give you advance notice. Before you start a paid plan, we'll provide a Critical Information Summary setting out the key details.
5. What the service needs to work
A Landie makes and receives calls over the internet, using your home internet connection. This means the service depends on your home internet and power being on. If your internet or power goes down, the Landie won't be able to make or receive calls. We provide the service on a commercially reasonable efforts basis and can't guarantee it will never be interrupted.
6. Emergency calls (000) — please read
A Landie can call 000, but only while your home internet connection is live. If your internet or power is down, the Landie cannot make any calls, including to 000. Because of this, you should always keep another way to call for help in an emergency — such as a mobile phone. Landie is not a guaranteed emergency communication service.
7. Acceptable use
You agree not to use a Landie: for anything unlawful, or to harass, threaten, or abuse anyone; for spam, telemarketing, or commercial calling; to resell the service or share your account; or to tamper with, reverse engineer, or interfere with the device or service.
8. Your account and information
Please give us accurate information and keep it up to date. As the account holder, you're responsible for your account and for how the Landie is used in your home.
9. Refunds and returns
Before your phone ships, your pre-order is fully refundable — just contact us. Once your Landie has shipped, our Refund Policy applies, including our 30-day satisfaction guarantee and 12-month warranty. Nothing in these terms limits the consumer guarantees you have under the Australian Consumer Law.
10. Consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms reduces those rights.
11. Intellectual property
Everything on our website — text, graphics, images, logos, and software — belongs to Landie and is protected by law. You can't copy, reproduce, or modify it without our written permission.
12. Liability
To the extent permitted by law (and subject to your Australian Consumer Law rights in sections 9 and 10), Landie is not liable for indirect, incidental, or consequential loss, and our total liability to you is limited to the amount you've paid us. We're not responsible for interruptions caused by your internet connection, power supply, or other things outside our reasonable control.
13. Complaints and disputes
If something's wrong, please contact us first at hello@landie.com.au — we'll do our best to sort it out. If we can't resolve it together, you can escalate a complaint about your phone service to the Telecommunications Industry Ombudsman (TIO) at tio.com.au or 1800 062 058. These terms are governed by the laws of New South Wales, and the courts of New South Wales have jurisdiction.
14. Changes to these terms
We may update these terms from time to time and will change the "Last updated" date above.
15. Severability
If any part of these terms is found to be invalid, the rest still applies.
